Supervisors can and should be held to a higher standard when it comes to enforcing workplace rules. That includes punishing a supervisor who harasses a subordinate more harshly than a co-worker who harasses a colleague.
Recent case: Vernard is a black male. He worked his way up to interim dean of workforce development at Alamo Community College in San Antonio. His job included supervisory and hiring responsibilities.
When he asked for a secretary to help him plan activities at off-site locations, he got a temp from an agency. Soon, the two were engaging in a sexual relationship that Vernard would claim was completely consensual. He broke up the relationship after the college changed its sexual harassment policy to ban even consensual relationships between supervisors and subordinates.
That?s when the woman filed a sexual harassment complaint with the college. She claimed that the relationship was not consensual and that she only participated because Vernard promised her a permanent job.
Alamo Community College fired Vernard, concluding he was guilty of sexual harassment and that the relationship had not been a permitted consensual one under the old rule?s criteria.
Vernard sued, alleging a Hispanic employee who harassed a co-worker was not fired.
The court tossed out Vernard?s case, noting that co-worker harassment is different from supervisor harassment and those in high-level jobs can be held to higher standards. (Grice v. Alamo Community College, No. 04-12-00524, Court of Appeals of Texas, 2013)

"Hunger Games" star Jennifer Lawrence told Vogue that she always knew she'd be famous, even if she wasn't sure what career path she'd take to get there. Lawrence is the cover girl for the magazine's enormous September issue, and recently sat for a seven-hour interview with writer Jonathan Van Meter.
Lawrence grew up in Kentucky, and says she didn't always fit in with her peers, but she always knew fame was in the cards. "I used to lie in bed and wonder, 'Am I going to be a local TV person? Am I going to be a motivational speaker?' " she said. "It wasn?t a vision. But as it?s kind of happening, you have this buried understanding: Of course.?
And she was right. Lawrence left school at 15 to begin acting, and hit it big with "Winter's Bone" in 2010.?
Her sudden fame, and the adustment that followed, helped her relate to her most famous character, Katniss Everdeen. In the second "Hunger Games" film, "Catching Fire," Katniss has changed from a unknown girl to a nationally famous face. Lawrence understands the transformation.
"Suddenly I was introduced to this brand-new world where I didn?t feel like myself," she told the magazine of her sudden celebrity. "I was in these weird gowns and listening to people talk about things I didn?t understand. And I remember reading that in the book and being like, Oh, my God, I know exactly what this feels like. I don?t know what it?s like to get ready for your death, but I do know what it?s like to be almost a puppet. And then when I was making the second film, I had become more acquainted with that world, and I think that?s something that Katniss experiences. She is different when she comes back. "
Lawrence is also excited about producing the film version of "The Glass Castle," the acclaimed memoir written by former msnbc.com gossip columnist Jeannette Walls.
?Jeannette wanted to fit in a polished world, so she?d shower all the time because she never felt clean,? Lawrence says. ?I find that, to watch somebody for two hours, you want her to have a little dirt on her, to be a little tacky, you know? I feel like you like those people more.?
"Catching Fire" hits theaters Nov. 22.

CAIRO (AP) ? Supporters of Egypt's ousted president have dug in at their two Cairo sit-ins after security officials said police would besiege the entrenched protest camps within 24 hours ? perhaps as early as Monday morning.
The development sets the stage for a possible confrontation between the military-backed government and the thousands gathered at the protest sites in support of ex-President Mohammed Morsi.
The protesters have said they will not leave until Morsi, ousted in a popularly supported coup on July 3, is reinstated.
Weeks of efforts by the international community to end the standoff and find a peaceful resolution have so far failed. Egypt's interim prime minister warned just ahead of the Muslim Eid al-Fitr holiday that ended Sunday that the government's decision to clear the sit-ins was "irreversible."
Egypt's new leadership says the protests have frightened residents of Cairo, sparked deadly violence and disrupted traffic. Leaders of the sit-in say they have been peaceful and blame security forces and "thugs" for violence. More than 250 people have killed in violence since Morsi's ouster.
At the main Cairo sit-in, vendors said they have sold hundreds of gas masks, goggles and gloves to protesters readying for police tear gas. Three waist-high barriers of concrete and wood have been built against armored vehicles.
The security officials said they would set up cordons around the protest sites to bar anyone from entering, and one of the officials said that could begin as soon as sunrise.
But by dawn Monday, there was no indication of any troops moving and the government has not confirmed when forces would advance on the sit-ins.
The Interior Ministry has said it would take gradual measures, issuing warnings in recent weeks and saying it would use water cannons and tear gas to minimize casualties.
Interior Ministry officials, speaking to The Associated Press on condition of anonymity because they are not authorized to discuss details of the security plans, said they are prepared for clashes that might be set off by the cordons. The officials said police are working with the Health Ministry to ensure ambulances are on hand for the wounded and that armored police vans are nearby to take away those arrested.
A special force within the riot police trained for crowd dispersal is expected to deal with protesters. In the past, however, Egypt's riot police, many lacking the training to deal with unarmed civilians, have resorted to using lethal force.
Mass rallies two weeks ago called by Egypt's military leader, Gen. Abdel-Fattah el-Sissi, showed that a large segment of Egypt's population backs the armed forces' actions against Morsi's supporters.
Just before the holiday, the government said international efforts failed to reach a diplomatic solution to the standoff with Morsi's supporters, who include members of his Muslim Brotherhood. A last-ditch effort was launched over the weekend by the Sunni Muslim world's pre-eminent religious institution, Al-Azhar, to push for a resolution.
There are fears that violence from police trying to clear the two sites will spread to other areas of the capital and beyond, where thousands of Morsi supporters also hold near-daily marches.
The main protest camp in Cairo is between middle-class residential buildings and ground floor businesses. Its focal point is a mosque and an adjacent stage where Brotherhood leaders charged with inciting violence openly talk to journalists.
Among them is former lawmaker Mohammed el-Beltagy, who vowed over the weekend to continue protesting at the sit-ins.
"We will happily sacrifice our souls, not for ourselves but to free the captured nation and to ensure freedom and dignity to our people and to the coming generations," he said.
Security officials, speaking anonymously because they are not authorized to release the information, suspect Brotherhood guards around the mosque in Rabaah al-Adawiya Square are well-armed. They also say both camps have armed protesters on rooftops ready to shoot.
The Interior Ministry has depicted the encampments as a public danger, saying 11 bodies bearing signs of torture were found near both sites.
Amnesty International has also reported that anti-Morsi protesters have been captured, beaten, subjected to electric shocks or stabbed. At least eight bodies have arrived at a morgue in Cairo bearing signs of torture, the human rights group said.
Of the more than 250 people killed since Morsi's ouster, at least 130 were his supporters who died in two clashes with security forces last month.
At the Cairo sit-ins, the overwhelming majority echo the demands of the Muslim Brotherhood: Restore Morsi to power and reverse all the actions taken by the military, including suspension of the disputed constitution and disbanding of the legislature.
Many of those interviewed dismissed the mass protests against Morsi in the final weekend of June that preceded the military coup. They acknowledge that Egypt is sharply divided, but worry that if they do not defend the sit-ins, they will be detained and tortured ? just as many were before the 2011 uprising that toppled autocrat Hosni Mubarak.
They say they waited for hours to vote for Morsi in the elections that catapulted his Brotherhood to power after years of oppression and that the military leaders have now stolen their children's future by overturning the outcomes of the balloting.
Um Roqiya said she will remain camped out with her five children, despite concerns for their safety.
"We are here to defend legitimacy. If I die defending that, we are martyrs," she said while patting her 7-year-old son on the head.
Her husband, longtime Brotherhood member Abdel-Latif Omran, said he can do nothing to protect his children from death because their fate has already been decided by God.
Organizations like UNICEF have condemned what it calls the deliberate use of children in Egypt who are "put at risk as potential witnesses to or victims of violence." The Brotherhood says it cannot control families that choose to camp out.
Neither authorities nor the guards have made clear how women and children will be able to safely leave if rocks start flying and tear gas is fired. In past clashes, birdshot and live bullets were allegedly used by both sides.
Saber Mohammed Mansour, who is from Egypt's Sinai Peninsula, has spent 44 days as a guard at the main camp. Dressed in a traditional "galabiya," a long loose garment, Mansour said he is willing to die for the cause.
Mansour and his fellow civilian guards, who wear hardhats and stand behind the sandbags, say their only weapons are the sticks they wield.
For Morsi supporters, the sit-ins are one of the last ways to express themselves against the new government. TV channels sympathetic to Morsi were shut down after they appeared to incite violence. Morsi and top leaders of the Brotherhood have been detained and are facing criminal investigations.

KABUL ? Depending on who you talk to, a Chinese man who disappeared after a deadly attack in the Afghan capital last week either made a daring escape from kidnappers or is a murder suspect who fled the scene of a quadruple slaying.
The man, who has not been named, along with another Chinese national, disappeared after four people were shot to death at a house party in Kabul Thursday night, according to Afghan officials. Three of those killed were Chinese nationals ? a man and two women ? and the fourth was their Afghan guard, according to Xinhua, the official Chinese news agency.
Quoting Chinese embassy officials, Xinhua, reported that one of the men who disappeared was taken hostage by Afghans but managed to untie himself, jump out of his captors? car and find safety at a U.S. military base, before being transferred to ?a safe place? by embassy officials.
Officials with the NATO-led International Security Assistance Force confirmed that a Chinese national came to the gate of a base in eastern Afghanistan Friday and was helped by troops there before being flown by military aircraft to Kabul, where he was met by Chinese officials. They said they could not speculate on any involvement he may have had with the Kabul shooting.
?We can confirm that ISAF provided assistance to a Chinese citizen in order to facilitate his safe return to Chinese diplomatic representatives in Kabul, Afghanistan,? Col. Jane E. Crichton said.
Afghan officials, however, gave a different version of the story than that reported in Chinese media.
Ministry of Interior spokesman Sediq Sediqqi said that the two Chinese men fled the scene of the party and are suspects in the slaying. Sediqqi said one of the men who disappeared was picked up by Afghan police officers and is being interrogated.
?It could be an internal issue because there is no indication of terrorism,? he said.
No one answered the phone at the Chinese Embassy Sunday.
The motivation for the attack, which occurred in a residential neighborhood of Kabul, is unclear. A Taliban spokesman denied the insurgent group was involved. Such attacks on foreigners are still relatively rare in Kabul, though there have been several kidnappings this year.
Police are still searching for the second Chinese man who disappeared from the scene, Sediqqi said.
There is a small Chinese community in Kabul, some of whom run small businesses, and a larger Chinese contingent working on natural resource ventures, such as mining. The three Chinese who were killed and the two who disappeared were all ?self-employed business people,? according to Xinhua.

JERUSALEM (AP) ? The office of Israeli Prime Minister Benjamin Netanyahu says that he has successfully undergone hernia surgery.
Netanyahu's office said early Sunday he is recuperating at a Jerusalem hospital following overnight surgery for an umbilical hernia. A medical team diagnosed the hernia after Netanyahu felt pain on Saturday.
The Prime Minister was given general anesthesia, and Defense Minister Moshe Yaalon was appointed acting Prime Minister during the few hours Netanyahu was unconscious. Netanyahu will be released later Sunday to recuperate further at home.
The weekly Cabinet meeting has been postponed.
The prime minister's office says Defense Minister Yaalon is leading a ministerial meeting on prisoners' affairs in Netanyahu's place.
Ministers are expected to approve the release of 26 Palestinian prisoners as part of U.S.-led Israeli-Palestinian peace talks that begin this week.

SAN FRANCISCO (AP) ? With an eleventh hour order, Gov. Jerry Brown averted a strike of San Francisco's Bay Area Rapid Transit system late Sunday night, easing the minds of hundreds of thousands of anxious commuters.
In the order, Brown named a board of investigators for a seven-day inquiry into the contract dispute that threatened to shut down, beginning Monday, the nation 's fifth largest rail line.
Brown's order comes under a law that allows the state's intervention if a strike will significantly disrupt public transportation services and endanger public health.
"For the sake of the people of the Bay Area, I urge ? in the strongest terms possible ? the parties to meet quickly and as long as necessary to get this dispute resolved," Brown said in the order.
In a statement, BART spokesman Rick Rice said the transit authority's board president Tom Radulovich sent a letter to the governor requesting his intervention and a cooling off period of 60 days. The governor issued an order with considerably less time of a week.
"The formal impartial fact-finding that accompanies the cooling-off period will help clarify the points of difference between the proposals," the statement said.
Union leaders issued a critical statement after the order, accusing BART management negotiators of stalling until only hours remained before the strike would have begun to provide counter proposals on core pay and benefits.
"Our hope is that the Governor's Board of Investigation will reveal how little time BART management has spent at the bargaining table in the past 30 days, compared with how much time they've spent posturing to the media," said SEIU 1021 President Roxanne Sanchez.
BART spokeswoman Alicia Trost said late Sunday that it is "extremely frustrating" that the unions were misrepresenting the improved proposals they've been getting, including wage increases, and the transit authority was hard at work all weekend despite allegations of absence.
"We made several proposals this weekend and they all went in one direction and that was up, up, up," said Trost.
Bay Area Rapid Transit managers and union leaders had returned to the bargaining table Sunday in hopes of heading off a strike that would have affected 400,000 commuters and created traffic nightmares for the San Francisco area for the second time in a month.
Representatives from BART management and the agency's two largest employee unions negotiated for about 14 hours Saturday and resumed bargaining Sunday morning as a midnight deadline loomed. Brown's order came at around 10:30 p.m. Sunday.
Big differences remain on key issues including wages, pensions, worker safety and health care costs, but the parties had expressed some optimism that an agreement could be reached to avert a strike planned for Monday.
Despite allegations of stalling late Sunday, earlier in the weekend union leaders cautiously expressed hope for agreement and said progress was being made.
"The parties made some important but incremental moves yesterday, and I hope to get to a deal," Josie Mooney, chief negotiator for the Service Employees International Union 1021, said Sunday before heading into negotiations. "If the parties work very hard, then it's certainly possible in the amount of time we have left."
"There was definitely movement from both sides," BART chief negotiator Thomas Hock said as he left negotiations late Saturday night. "Hopefully, if we keep moving, we will get to a proposal that both sides can agree to."
BART's two largest unions issued a 72-hour notice Thursday that employees would walk off the job if they didn't reach agreement on a new contract by midnight Sunday.
"BART really is the backbone of the transit network. No other transit agency has the ability to absorb BART's capacity if there's a disruption," said John Goodwin, spokesman for the Metropolitan Transportation Commission.
In the event of a strike, transit agencies had planned to add bus and ferry service, keep carpool lanes open all day and even give away coffee gift cards to encourage drivers to pick up riders. They were also encouraging workers to avoid peak traffic hours or telecommute if possible.
When BART workers shut down train service for four days in early July, roadways were packed and commuters waited in long lines for buses and ferries. The unions agreed to call off that strike and extend their contracts until Sunday while negotiations continued.
Bay Area and state officials have been pressuring BART managers and union leaders to reach an agreement this weekend, saying a strike would create financial hardship for working families and hurt the region's economy.

Sir Bradley Wiggins has bounced back to form by taking the honours in the 37km time trial at the Tour of Poland.
The Briton claimed glory at the Tour de France and the Olympic time trial in 2012 but had not won since then, a barren run lasting more than a year.
However, that all changed on Saturday when he destroyed the field on stage seven, clocking a time of 46 minutes and 36 seconds to finish almost one minute clear of second-placed Fabian Cancellara.
It was the final stage of the race with Pieter Weening finishing sixth on the day to take the general classification, beating Ion Izagirre into second and Christophe Riblon into third.
Wiggins' success is a timely boost with concerns raised recently over his condition and fitness and he will next be in action in the Eneco Tour in Holland from August 12-18.
The Tour of Britain will be next on the agenda for Wiggins after that from September 12, before his primary goal of the Road World Championships on September 25 in Florence, Italy.

NRF: Retail Industry Adds 37,000 Jobs in July
Washington, August 2, 2013 ? The National Retail Federation today issued the following statements from President and CEO Matthew Shay and Chief Economist Jack Kleinhenz on the July employment numbers. NRF pegged retail job gains at 37,000 in July, with increases in general merchandise, food and beverage and building and garden supply stores.
?In spite of continued rancor and uncertainty from policymakers in Washington, the private sector economy continues to add jobs,? NRF President and CEO Matthew Shay said. ?While unemployment remains stubbornly high, with millions of Americans jobless or underemployed, retailers are adding to their ranks and payrolls.?
?Contrary to the record increases on Wall Street, employment continues to be a lagging indicator of the recovering economy,? NRF Chief Economist Jack Kleinhenz said. ?Despite the underwhelming and discouraging job gains in July, NRF expects the economy to pick up in the third and fourth quarters. The employment trend is positive, yet lackluster.?
The Bureau of Labor Statistics report today showed that the economy added 162,000 jobs in July, which lowered the unemployment rate to 7.4 percent.

'Total War: Rome II', a strategy computer game from SEGA.
They say that good things come to those who wait. ?Well, by that logic those who have been waiting for the sequel to PC game Total War: Rome?should expect great things from Total War: Rome II. ?After all, they've been waiting nine years for the darn thing.
Good or bad, players can be certain of one thing right out of the box: ?Rome II?is big. ?Really big.
"It's the biggest game we've ever made," said Studio Communications Manager?Al Bickham during a behind-closed-doors presentation of the game last week.
In fact (just in terms of the game map itself), players will find that it goes as far north as Scotland, down through the Mediterannian, from Portugal on the West through to the Middle East. ?Compared to that of developer Creative Assembly's previous game, Total War: Shogun 2, the game is enormous.
"The campaign map for?Rome II?- you know, the kind of turn based part of the game where the game of statecraft and expansion and diplomacy - that campaign map is huge," stated Bickham during a post-presentation one-on-one interview. ?"It's four times the size of?Shogun 2?in terms of scale."
In addition to having a vastly larger campaign map, Rome II?also offers a greater diversity in its units. ?Shogun 2?had some 40 different military units to command. ?Rome II?has in excess of 700.
But simply being large is one thing. ?Being good is something else entirely. ?Luckily, after having some hands-on time with an early build of the game, it seems that CA is doing just fine on that front as well. ?It's not perfect, but the game still has a little of development time left before it comes out in a little more than a month to work out the few remaining kinks.
A few technical caveats aside, Rome II?looks to be every bit the Total War?gameplay experience the franchise is known for and more. ?And the use of the word "more" is as figurative as it is literal.
In addition to simply winning battles (something easier stated than accomplished), players can also find victory in other avenues. ?This includes the ability to win by having a vastly superior culture to the game's many other factions. ?The game can also be won through economics. ?These win conditions are a little more Sid Meier's Civilization-like than Total War?players might be comfortable with, but CA seemed very happy the additions.
Another item easily noticed during play is the game's graphical presentation. ?While not exactly awe-striking on an item-by-item basis, the sheer scale of what the game has to render coupled with how good everything looks overall is quite impressive both in battle and out. ?It's of Bickham's opinion that the depth and detail found in Rome II (both visually and otherwise) are a couple of the things that will make the game stand out against its predecessors and others similar to it.
"We support that by letting the player get right up close when those big real-time battles happen with 40,000 guys clashing on ancient battlefields," he commented. ?"You know, you get the camera down there close and you can see each individual man fighting and they've got such a vast range of combat animations and it looks absolutely incredible."
Still, the Studio Communications Manager stated that gamers don't need a top-tier rig in order for Rome II?to be played.
"Our aim all along was to not shift the minimum spec of grade of PC you need to play it from?Shogun 2," he said. ?"We've pretty much hitting that; we're close to?Shogun 2's minimum spec."
Bickham then continued,?"But of course, if you've got a monster PC with two enormous graphics cards and a super-fast processor, we'll take every bit of power you can give us and give you the most visually stunning artistic experience you've ever seen."
Those looking to get their latest Total War?fix will be able to do so when SEGA launches the PC exclusive on the 3ds of September.
The ESRB has rated Total War: Rome II?as "T for Teen".

WASHINGTON (AP) ? A highly anticipated fall summit between President Barack Obama and Russian President Vladimir Putin could become a casualty of Moscow's defiant decision to grant temporary asylum to National Security Agency leaker Edward Snowden, the White House signaled Thursday after weeks of pressuring and pleading for his return to face prosecution.
Russia's decision "is not a positive development," White House spokesman Jay Carney said.
"We are extremely disappointed that the Russian government would take this step despite our very clear and lawful requests in public and in private to have Mr. Snowden expelled to the United States to face the charges against him," Carney said.
Obama is scheduled to go to Russia in September for the Group of 20 economic summit in St. Petersburg and also stop in Moscow for one-on-one talks Putin. The White House alternately has demanded that Russia return Snowden while also saying it doesn't want his case to negatively impact relations with Moscow.
Asked whether Obama would still travel to Moscow, Carney said pointedly, "We are evaluating the utility of a summit."
There was a strong reaction from some lawmakers.
"Russia's action today is a disgrace and a deliberate effort to embarrass the United States. It is a slap in the face of all Americans," Republican Sens. John McCain of Arizona and Lindsey Graham of South Carolina said in a joint statement. "Now is the time to fundamentally rethink our relationship with Putin's Russia."
The senators suggested expanding U.S. sanctions against Russians accused of human rights violations, completing U.S. missile defense programs based in Europe, and moving quickly on another round of NATO expansion to include the Republic of Georgia.
A top Democrat, Sen. Chuck Schumer of New York, said Obama should recommend moving the G-20 summit. Long before Thursday's decision, Graham suggested the U.S. boycott the Winter Olympics taking place next year in Sochi, Russia.
"Russia has stabbed us in the back, and each day that Mr. Snowden is allowed to roam free is another twist of the knife," Schumer said.
Carney declined to speculate about what steps, if any, the U.S. might take in response. He noted the complicated and wide-ranging relationship between the two countries and suggested the U.S. also is reluctant to let Snowden's status become the source of further deterioration.
The U.S. and Russia already disagree on a host of issues, including the civil war in Syria, where Moscow is one of Syrian President Bashar Assad's key supporters and the U.S. is backing anti-Assad rebel forces.
"There is no question that there are a range of issues, setting aside the disposition of Mr. Snowden, on which we are currently in disagreement with Russia," Carney said.
Snowden left the transit zone of a Moscow airport and officially entered Russia after authorities granted him asylum for one year, his lawyer said Thursday. Snowden had been camped out at the airport for more than a month since he arrived there from Hong Kong on June 23.
The U.S. had demanded that Russia send him home to face prosecution for revealing details about secret U.S. electronic surveillance programs. But the two countries have no extradition treaty and Putin dismissed the requests, despite saying he didn't want the Snowden issue to hamper relations with the U.S.
Carney said the U.S. was not told of the decision ahead of time.
Andrew Weiss, a former director of Russian affairs in the Clinton administration, said the Russians had sought an Obama visit so they could portray Putin as an important player on the world stage. But he said it now seems "all but inevitable" that Obama will have to cancel at least part of his trip to Russia in response.
"So something they really wanted, which was the president of the United States there in Moscow, now seems to be in jeopardy" because of Snowden, Weiss said.
Jeffery Mankoff, deputy director and fellow with the Russia and Eurasia program at the Center for Strategic and International Studies, said the meeting should go on because of the other important issues on the table.
"All of these things are kind of sitting there in the bilateral relationship and really need a top-level push to get anywhere," Mankoff said. "Having that kind of meeting would be conducive to getting some of that agenda moving."
